You and the other parent decide whether or not to take part in mediation. Your voluntary participation and <strong>willingness to play an active part in the mediation process<\/strong> are essential requirements for mediation.<\/li><li>A mediation process is <strong>unbiased<\/strong>: You and the other parent are <strong>responsible for formulating the aims and the content<\/strong> of a mediation process. One possible aim of mediation may be that you eventually reach an agreement that you have drawn up together. In contrast to judges, mediators have no interest of their own in a possible agreement.<\/li><li>You also decide on the <strong>duration<\/strong> of mediation and the <strong>number of sessions<\/strong>.<\/li><\/ul>\n\n\n\n<div class=\"wp-block-group is-style-infobox is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading\">A note on confidentiality<\/h3>\n\n\n\n<p>Since you decide on the content of mediation, you and the other parent can decide jointly how to approach the question of confidentiality.<\/p>\n\n\n\n<p>Mediators are bound to secrecy by law. The obligation of secrecy relates to the content and performance of mediation as well as to everyone involved in the process.<\/p>\n\n\n\n<p>Your mediator can help you to come to a decision about this issue.<\/p>\n<\/div>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"mediation-procedure\"><strong>The mediation procedure<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Distribution of roles<\/h3>\n\n\n\n<p>A mediator will give you a <strong>structured framework <\/strong>for your conflict and lead you through the process, usually through stages of mediation that have been defined beforehand. He or she will steer the process of agreement but will not take any decisions for you. Instead, the mediator will assume <strong>responsibility for the rules of play, the structure and the sequence<\/strong> of the mediation. As the conflicting parties, you are relieved of these tasks.<\/p>\n\n\n\n<p>People who have undertaken mediation training bring <strong>a variety of qualifications <\/strong>with them and may come from a variety of professional backgrounds such as legal studies, psychology, education or even perhaps engineering.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>It is generally helpful in cross-border family conflicts if the mediator has experience in this field and possesses expertise in legal, linguistic and intercultural matters.<\/p><\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\">Listen to points of view, identify needs<\/h3>\n\n\n\n<p>It will be of central importance to the mediation process that you and the other parent <strong>have space<\/strong> to put forward your own points of view. With the support of the mediator, attempts will be made during the process to shed light on the <strong>background factors and reasons<\/strong> behind your perspectives and individual positions. Your respective <strong>needs and interests<\/strong> should also be explored and identified. This is the basis for exploring possible solutions, which may then culminate in a joint agreement.<\/p>\n\n\n\n<p><strong>Mediation is impartial.<\/strong> This means that the mediator is committed to you and the other parent in equal measure.<\/p>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"young-people-mediation\"><strong>Children and young people in mediation<\/strong><\/h2>\n\n\n\n<p>What sort of role is played by children and young people involved in dealing with international family conflicts is a key question. It may take <strong>various forms, depending on the case constellation<\/strong>. <strong>Age and maturity<\/strong>, the <strong>needs of the parents<\/strong> and the <strong>experience<\/strong> of the person providing the mediation all play a role here.<\/p>\n\n\n\n<p>Various approaches are conceivable in a mediation process: <strong>an empty chair to represent the interests of the child or young person<\/strong> may be placed in the room, for example.
