We often encourage people to consider alternative solutions and to reach an amicable agreement. As well as family mediation, we put forward other methods for dealing with a conflict out of court.<\/p>\n\n\n\n<ul class=\"is-style-anchor wp-block-list\"><li><a href=\"#out-of-court-approaches\">What constitutes out-of-court approaches to conflict resolution<\/a><\/li><li><a href=\"#methods\">Methods of resolving family conflicts out of court<\/a><\/li><li><a href=\"#different-ways\">Different ways of resolving conflict may complement one another<\/a><\/li><\/ul>\n<\/div>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"out-of-court-approaches\"><strong>What constitutes out-of-court approaches to conflict resolution<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-group is-style-infobox is-layout-flow wp-block-group-is-layout-flow\">\n<p>In principle, there are <strong>two ways<\/strong> in which you and the other parent can settle your family conflict:&nbsp; one path leads to <strong>court<\/strong>, whilst the other remains <strong>outside the courtrooms<\/strong>.<\/p>\n\n\n\n<p>However, it is also conceivable that the two <strong>ways complement one another<\/strong>.<\/p>\n\n\n\n<p>There is no one right way. It depends on your general situation and what direction is appropriate for you and your family.<\/p>\n\n\n\n<p>We would therefore like to outline for you the main aspects of conflict resolution, both in court and out of court.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link\" href=\"https:\/\/zank.de\/en\/resolve-conflicts\/going-to-court\/\">More on legal approaches to conflict resolution in court<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<p>A key feature of access to any out-of-court service is the fact that <strong>its use is voluntary<\/strong>. This means that you decide whether or not and in what way you will take advantage of access to an advice centre, for example.<\/p>\n\n\n\n<p>Advisory processes and out-of-court procedures, such as mediation, are structured in such a way as to be <strong>flexible and unbiased<\/strong>. You and the other parent are given plenty of space to work on solutions <strong>independently<\/strong>.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>In out-of-court procedures, you can define the criteria for decision- making yourself.<\/p><\/blockquote>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-e64a8054-a3da-4ed0-b1b7-6f74930fd792\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-e64a8054-a3da-4ed0-b1b7-6f74930fd792\"><span class=\"accordion-button-text\">Limits<\/span><\/button><\/h3><div id=\"collapse-e64a8054-a3da-4ed0-b1b7-6f74930fd792\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-e64a8054-a3da-4ed0-b1b7-6f74930fd792\"><div class=\"accordion-body\">\n<p>This flexibility and open approach to resolving parental conflicts stops at the point where there are fears that the physical, mental or emotional <strong>welfare of the child <\/strong>is endangered.<\/p>\n\n\n\n<p>Likewise, it must be emphasised that an amicable resolution, which is based on direct communication, <strong>is not generally appropriate<\/strong> if the <strong>protection against violence and safety concerns of one party<\/strong>, due to previous incidents for example, argue against it.<\/p>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-f932b10e-77b2-4d09-a8a0-7cb0068d49a7\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-f932b10e-77b2-4d09-a8a0-7cb0068d49a7\"><span class=\"accordion-button-text\">Background of professionals who offer assistance<\/span><\/button><\/h3><div id=\"collapse-f932b10e-77b2-4d09-a8a0-7cb0068d49a7\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-f932b10e-77b2-4d09-a8a0-7cb0068d49a7\"><div class=\"accordion-body\">\n<p>In contrast to court proceedings, those who offer support may come from <strong>a variety of professional backgrounds<\/strong>: Your contact persons in advice centres are often social workers or educational experts; a mediator may have started his or her career in the field of philosophy, psychology, social sciences or legal studies.<\/p>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-2a39a992-07b9-4792-9f59-34fced970b68\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-2a39a992-07b9-4792-9f59-34fced970b68\"><span class=\"accordion-button-text\">Costs and funding<\/span><\/button><\/h3><div id=\"collapse-2a39a992-07b9-4792-9f59-34fced970b68\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-2a39a992-07b9-4792-9f59-34fced970b68\"><div class=\"accordion-body\">\n<p>There is a large variety of providers of out-of-court services, so there are also <strong>various forms of funding<\/strong>. Many<strong> counselling services <\/strong>are provided for you free of charge. Other procedures, <strong>for example mediation processes, <\/strong>are normally<strong> subject to a fee<\/strong>. It is helpful to enquire about potential costs right at the start of the counselling process.<\/p>\n<\/div><\/div><\/div>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"methods\"><strong><strong>Methods of resolving family conflicts out of court<\/strong><\/strong><\/h2>\n\n\n\n<div class=\"wp-block-group alignfull is-layout-constrained wp-block-group-is-layout-constrained\" style=\"padding-top:0;padding-bottom:3rem\">\n<h3 class=\"wp-block-heading\">Family counselling and child guidance<\/h3>\n\n\n\n<p>In Germany, c<strong>hildren and young people in need of advice<\/strong>, as well as their <strong>parents<\/strong>, have access to family counselling and child guidance. The advice is provided <strong>for you free of charge<\/strong>; the counsellors are bound by a <strong>duty of confidentiality<\/strong>. This professional association for child guidance and family counselling provides online advice as well as online search for advice centres. This method is used not only by municipal and regional social services, but also by voluntary bodies working in the field of child and youth welfare services.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Your local youth welfare office will be able to provide you with information and arrange contacts.<\/p><\/blockquote>\n\n\n\n<p>Professionals assume the <strong>role of neutral coordinators <\/strong>in the family group conference. A key feature of the family group conference is its <strong>participatory character<\/strong>.
