We have set out below the key aspects of the family court proceedings and in particular proceedings relating to child custody if there is a cross-border element.<\/p>\n\n\n\n<ul class=\"is-style-anchor wp-block-list\"><li><a href=\"#family-court-proceedings\">What family court proceedings consist of<\/a><\/li><li><a href=\"#family-court-proceedings\">The framework of proceedings before the family court<\/a><\/li><\/ul>\n<\/div>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"family-court-proceedings\"><strong>What family court proceedings consist of<\/strong><\/h2>\n\n\n\n<div class=\"wp-block-group is-style-infobox is-layout-flow wp-block-group-is-layout-flow\">\n<p>In principle, there are two ways in which you and the other parent can solve your family conflict:&nbsp;one path leads to court, whilst the other remains outside the courtrooms.<\/p>\n\n\n\n<p>However, it is also possible that the two ways complement one another. There is no one right way. It depends on your general situation and what direction is appropriate for you and your family.<\/p>\n\n\n\n<p>We would therefore like to outline for you the main features of conflict resolution, both in court and out of court.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link\" href=\"https:\/\/zank.de\/en\/resolve-conflicts\/out-of-court-conflict-resolution\/\">More on out-of-court conflict resolution<\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<p>Some questions arise if you decide to go to court or if the other parent has already initiated court proceedings. <strong>Many parents find themselves in a situation that is completely new to them.<\/strong><\/p>\n\n\n\n<p>However, there is some degree of predictability. The <strong>central rules of procedure <\/strong>such as &#8220;fairness&#8221; and &#8220;justice&#8221; <strong>are regulated by law<\/strong>, as is the question of the <strong>decision-making authority<\/strong>. The decision-making criteria are also defined beforehand in terms of substance, i.e. content: the current legal situation and legislation governing custody and rights of access apply. The costs of court proceedings are also legally regulated and can in principle therefore be calculated beforehand.<\/p>\n\n\n\n<h2 class=\"is-style-heading-h2 wp-block-heading\" id=\"framework-of-proceedings\"><strong>The framework of proceedings before the family court<\/strong><\/h2>\n\n\n\n<p>Specifically, this means that there is no need for you to negotiate on the above-mentioned points as the court works within a clear framework:<\/p>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-dec558cd-150d-4057-a41e-71fa34ea00c8\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-dec558cd-150d-4057-a41e-71fa34ea00c8\"><span class=\"accordion-button-text\">Jurisdiction<\/span><\/button><\/h3><div id=\"collapse-dec558cd-150d-4057-a41e-71fa34ea00c8\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-dec558cd-150d-4057-a41e-71fa34ea00c8\"><div class=\"accordion-body\">\n<p>In Germany, jurisdiction for deciding in family conflict cases normally lies with the <strong>family court<\/strong>. In principle, the court of the place in which the child has their habitual residence, i.e. <strong>the child\u2019s primary place of residence<\/strong>, has jurisdiction in custody and access conflicts.&nbsp; If the child&#8217;s primary place of residence is in a foreign (European) country, the local (family) court there has jurisdiction.<\/p>\n\n\n\n<p>If you live in Germany and wish to conduct custody or access proceedings abroad, the <strong>Federal Office of Justice as the Central Authority for international custody conflicts<\/strong> can provide further information and support.<\/p>\n\n\n\n<p>The Federal Office of Justice can likewise give you details of which courts are in charge of your application if there is a cross-border element.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link\" href=\"https:\/\/www.bundesjustizamt.de\/EN\/Topics\/citizen_services\/HKUE\/HKUE_node.html\">To the pages of the Federal Office as Central Authority<\/a><\/div>\n<\/div>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-94fb2731-3c16-4c29-b4cb-3561ff60f96a\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-94fb2731-3c16-4c29-b4cb-3561ff60f96a\"><span class=\"accordion-button-text\">Who decides<\/span><\/button><\/h3><div id=\"collapse-94fb2731-3c16-4c29-b4cb-3561ff60f96a\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-94fb2731-3c16-4c29-b4cb-3561ff60f96a\"><div class=\"accordion-body\">\n<p>A judge is the decision-making person. This means that the <strong>professional qualifications<\/strong> of the decision-making authority are also defined in advance. The judge is bound by the <strong>current legal situation and legislation<\/strong> when reaching a decision.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>As a rule, therefore, family court proceedings end with a decision by an external third party which is binding for both parents.<\/p><\/blockquote>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-theme-accordion accordion-item\"><h3 class=\"accordion-header\" id=\"heading-4abe961c-935a-44d8-8ed2-c5c278ade5ca\"><button class=\"accordion-button collapsed\" type=\"button\" aria-expanded=\"false\" aria-controls=\"collapse-4abe961c-935a-44d8-8ed2-c5c278ade5ca\"><span class=\"accordion-button-text\">Amicable agreement within court proceedings<\/span><\/button><\/h3><div id=\"collapse-4abe961c-935a-44d8-8ed2-c5c278ade5ca\" class=\"accordion-collapse collapse\" aria-labelledby=\"heading-4abe961c-935a-44d8-8ed2-c5c278ade5ca\"><div class=\"accordion-body\">\n<p>Procedural law provides for the judge <strong>to work towards an amicable agreement between the parents<\/strong> during the proceedings. In Germany, for example, depending on the constellation of the case the judge may have to appoint a <strong>guardian ad litem for the child.<\/strong> The guardian ad litem has the task of <strong>representing the interests of the child effectively<\/strong>. A guardian ad litem must be appointed for a child if, for example, those who have physical custody of the child, i.e. normally the parents, are not in a position to represent the interests of the child effectively. This is the case if, for example, custody has been (partially) withdrawn from them. It may also be necessary if the right of access of one parent should be restricted.<\/p>\n\n\n\n<p>In matters of parental responsibility, custody and access disputes for example, there is <strong>no statutory requirement to be represented by a lawyer<\/strong> before the local, regional and Higher Regional courts. It can nevertheless be helpful in many cases if a <strong>lawyer who specialises in family law<\/strong> is there to support and represent you.<\/p>\n\n\n\n<p>It is important to choose someone with <strong>knowledge of European and international family law<\/strong>. If the conflict has a cross-border element, experience in the application of European legal provisions such as the Brussels IIa Regulation and of the Hague Conventions should be a prerequisite.<\/p>\n\n\n\n<p>Since legal advice requires a high degree of specialisation in international family law, it is common practice for lawyers in this field to charge hourly rates agreed in advance.
